Summary of Proposed By-law No. 21 – A By-Law Respecting the Operation of Retail Businesses in the Municipality of Salisbury (Sunday Shopping)

A new by-law is proposed to replace the former Village of Salisbury Sunday Shopping By-Law (By-law No. 39) and be for the entire Town. Without a municipal by-law in place, a retail business (as defined in the New Brunswick Days of Rest Act) is only allowed to operate on Sundays during the Provincial Sunday shopping period which, citing the Act, runs from the Sunday before New Brunswick Day through to the second Sunday after Christmas. (It must also be noted that it is clarified in the Days of Rest Act that there are certain types of retail businesses that are exempt from the Act and may be open on Sundays, regardless.) Under the proposed updated by-law, Salisbury retail businesses throughout the entire Town would be permitted to set their own Sunday hours, should they choose, and not be restricted to 1:00-5:00 PM as stated in the Act, provided they follow labour laws.
